Youth–led First Nations environmental group Youth Verdict (one of the Petitioners) sought to object to the Galilee Coal Project, on the basis of alleged human rights violations — more concretely, the right to life, the protection of children, and the right to culture as protected by the Queensland Human Rights Act.

Although the Galilee Coal (mining) Project had already received federal approval, the Queensland Land Court had to issue a (non-determinative) recommendation, to be considered by the Chief Executive of the Department of Environment and Science, when deciding on the mining lease of the Galilee Coal Project.

Decision

In this landmark decision, the Land Court of Queensland has recommended that a major proposed coal mine should not go ahead because of its contribution to climate change, its environmental impacts, and the unjustifiable limitations on human rights that it would pose.
